
Liability Release for Overnight Campers
RELEASE OF LIABILITY On behalf of myself and for my family, heirs, administrators, executors, personal representatives, and assigns, hereby acknowledge and agree that The Great Mountain Forest Corporation (“GMFC”) and Yale University (“Yale”) are not liable or responsible for any personal injury or property damage sustained through my use of the Yale Forestry Camp facility located in Canaan, Connecticut, and hereby represent and warrant as follows:
- I am over the age of 18.
- I understand and agree that there are risks associated with my use of the specified Yale Forestry Camp facility, that neither GMFC nor Yale has made any representations as to the condition or safety of the Yale Forestry Camp, and I assume all the risks and responsibilities involved with my use and activity. I also agree to abide by the rules and regulations for the Yale Forestry Camp, and any other applicable laws.
- I forever release, discharge, waive, and covenant not to sue GMFC or Yale, their officers, directors, employees, agents, representatives, attorneys, predecessors, successors, contractors, and assigns (collectively “Releasees”) for any liability, claim, damage, action, cause of action, loss, cost, or expense (including attorneys’ fees) of any nature whatsoever arising out of or relating to any loss, damage, personal injury, or death sustained by me while using their facilities, including but not limited to any loss, damage, personal injury, or death caused or alleged to be caused by the negligence or future negligence of the Releasees.
- I agree that this Release of Liability shall be binding upon me and my family, heirs, administrators, executors, personal representatives, and assigns.
- I understand and agree that my use of the Yale Forestry Camp pursuant to this Release of Liability (including any associated fees) shall not affect the statutory protections afforded to GMFC and Yale pursuant to Conn. Gen. Stat. §§ 52-557f through 52-557k relating to the use of private lands by the public free of charge.
- This Release of Liability shall be construed under Connecticut law. To the fullest extent permissible by law, the parties irrevocably submit to the exclusive jurisdiction of Connecticut for resolution of any dispute arising under this Release of Liability. In the event that any provision or clause of this Release of Liability conflicts with applicable law, such conflict shall not affect other provisions of this Release of Liability which can be given effect without the conflicting provision. To this end the provisions of this Release of Liability are declared to be severable
